Domestic Violence Offender Gun Ban for Hunters
The Domestic Violence Offender Gun Ban is a Federal Law that prohibits anyone convicted of a crime of domestic violence in South Carolina from using or possessing a firearm.
There are no exceptions to this law for hunters. The law does not prevent the South Carolina Department of Natural Resources from issuing a hunting license, but it would make it a serious offense to actually conduct any hunting with a firearm.
This is an automatic penalty that comes with any CDV conviction. The Court or the police won't have any discretion with how the Domestic Violence Offender Gun Ban applies in your case. In addition to the gun ban if you are convicted you will also face the possibility of a jail sentence or fine.
If you or a loved one is a hunter charged with Criminal Domestic Violence (CDV) please contact the Law Office of James R. Snell, Jr., LLC, to discuss your legal rights. Call (803) 359-3301.
