How many people are on a CDV trial jury?

Anyone charged with CDV in South Carolina is eligible to receive a full trial by jury. Jury trials are not conducted on the Court date written on a CDV citation or on the information provided by the Bond Court.

CDV cases tried in the Magistrate court are tried before six jurors.

CDV 2nd offense cases tried in Transfer Court are tried before six jurors. A defendant must consent to having their case tried in Transfer Court as opposed to General Sessions.

CDV 3rd offense or DVHAN cases tried in General Sessions are tried before twelve jurors.
